Can my ex-boss do this?

started working franchise few months ago. job managing social media worked on various other things well. worked home , use iphone app clock hours , describe work did. got fired couple days ago because sales down. went pickup final check today , noticed 12 hours missing, cutting check in half. long story short, after talking , forth boss on phone , emailing , texting, said work described didn't match hours clocked. refuses pay me rest of time worked! on top of of this, never sent w-2 form. started working in late december , got 1 check him in 2012 figured use pay stub needed employer id number. dragged sending me , disregarded inquiry w2. when picked last check, talked coworker , told him missing w2. opened desk , told me put them in there , mine in there well. boss never told me it. should do?
